Section 161 notices: proving a payee's ATL status

By CheckOne by FormOne · Updated 21 Oct 2026

Section 161 of the Income Tax Ordinance makes a person who was required to withhold tax, and did not withhold it or withheld too little, personally liable for the shortfall, with default surcharge. FBR issues notices under this section to withholding agents.

Prepare records for your advisor

Keep the notice, payment voucher, invoice, payee identifier and the basis for the withholding treatment together. Match each payment to the check and source file available at that time. A lookup performed today does not reconstruct an earlier result, and the evidence pack does not replace a professional response to the notice.

What good evidence looks like

  • The payee's identifier and the status found.
  • The FBR file the status came from: its published date and a fingerprint (sha256) so it can be matched to the file.
  • The date of the check, on or before the payment date.
  • The rate table version used for the section.

CheckOne keeps this record for every vendor on every weekly check and can produce a section 161 pack: for each payment you list, the status in the latest stored file of each source published on or before the payment date, with its hash and publication-date basis. The file establishes membership on its publication date, not continuous confirmation through payment time. It does not replace your advisor’s response to the notice. See a sample pack.

Read the sample chronology carefully

The sample pack uses a fictional 9 October payment, a 5 October source file and a later 12 October result. The earlier file is the latest stored source published on or before the payment. It establishes membership on its publication date, not uninterrupted status until payment.

Record gaps instead of filling them with assumptions

If no relevant file was stored for the period, document that limitation and give your advisor the records you do hold. Do not present today’s status as historical proof. A file hash identifies the retained bytes; it does not certify the legal conclusion or guarantee acceptance of a response.
